Purchase of online programs from Defiant CrossFit is an acceptance of the following Waiver, Release and Assumption of Risk -

a. The participant (hereinafter referred to as Athlete) understands and agrees that he/she is voluntarily participating in physical activities that may expose Athlete to some level of risk, injury or illness and Athlete represents that he/she is aware of the nature of these activities and agrees to accept any and all risks associated with participation in these activities.

b. Athlete represents that he/she is in good physical health. Athlete agrees to indemnify and hold Defiant CrossFit harmless, as well as its directors, agents, officers, independent contractors and employees, against loss (including reasonable attorney fees) from any and all claims of negligence, demands, rights, or causes of action of any kind or nature that may hereafter at any time be made or brought by Athlete or on Athlete’s behalf for any know or unknown, foreseen or unforeseen bodily or personal injuries, damages to property and consequences thereof which may be sustained by Athlete as a direct or indirect result of participating in the aforementioned program.

c. Athlete has read, and fully agrees to the term of this Agreement and understands and agrees that by purchasing this program Athlete has given up considerable future legal rights. Athlete accepts this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her. Athlete certifies and warrants that he/she is 18 years of age or older and mentally competent to enter into this Agreement.

A copy of Defiant's cancellation policy can be found in your red folder that you received during your New Athlete Orientation.

I understand that it is my responsibility to submit this form with a 15 days notice.

I understand that by submitting this form with less than 15 days notice will result in my automatic payment being billed to my account.

I understand that there are no refunds for paid fees, regardless of circumstances.

FEES

Cancellation of your onsite training prior to the expiration of your initial 3 months commitment period requires an early termination fee equal of $150 regardless of circumstances unless due to severe injury requiring hospitalization or surgery. I understand that a Cancellation fee will be applied to my account at the time of cancellation. * There are no cancellation fees for Virtual Memberships.

REACTIVATION

If you choose to reactivate your training in the future (and we hope you do!), rates in effect at the time of reactivation will be applicable as rates are subject to change.

I understand that reactivating my membership in the future will incur rates in effect at the time of reactivation.

Membership Hold requests are limited to one per year, in increments of either 30, 60 or 90 days.

Reason for Hold

* If you are working through an injury that does not require surgery, continue coming to classes and your Coach will modify your movements and WODs around your injury until you're healed or contact us to be placed on Injury Protocol.

SUBMISSION

Holds must be submitted no less than 7 days prior to your next billing date. Requests received after this time will not be processed until the following billing date. All payments are non-refundable.

I understand that a Hold request must be submitted no less than 7 days prior to the Hold date in order to suspend the next scheduled payment.

REACTIVATION

Upon expiration of your requested Hold period, your account will automatically reactivate and regular payments will resume.

I understand that my membership and payments will automatically resume upon expiration of my requested Hold period.

I understand that canceling my membership during the Hold period will apply the standard cancellation fees to my account.
